“One can argue that SBF has cleverly constructed a straw man that he can knock down, without addressing the main allegations of the indictment,” said Kevin O’Brien, a New York-based partner at Ford O’Brien Landy LLP who specializes in white-collar criminal defense. He called Bankman-Fried’s blog post “good PR.”
“But will it serve him when his criminal case goes to trial? It might sway some jurors, but, as someone once said, ‘Facts are stubborn things,’” O’Brien said.
