“The judge shouldn’t be sparring with defense counsel, especially about things that aren’t part of the case,” said Kevin O’Brien, a white collar partner at Ford O’Brien Landy LLP and former federal prosecutor for the Eastern District of New York.
“He should just save his powder and write the opinion he needs to write to satisfy his sense of law and justice,” O’Brien added. “Why do something that would call attention to his alleged bias or failure to be fair to Trump? It also provokes another round of public insults from Trump. None of that helps the judge or the process.”
